A legally binding agreement between you and TryAlgoViz, a sole proprietorship registered under the laws of India. By creating an account or using the platform, you agree to these terms.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TryAlgoViz ("Platform," "we," "us," or "our"), a sole proprietorship registered under the laws of India.
By registering an account, accessing, or using our Software-as-a-Service (SaaS) learning platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Platform.
Eligibility. You must be at least 18 years of age, or have the consent of a parent or legal guardian, and be fully competent to enter into the terms, conditions, obligations, and representations set forth in these Terms.
Account creation. To access our learning modules and tracking features, you must register for an account by providing a valid email address and setting up a secure password.
Account security. You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use or security breach of your account. We are not liable for any losses caused by unauthorized use of your account.
SaaS license grant. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Platform solely for your personal or internal business learning purposes.
Prohibited conduct. You agree not to:
Ownership. All intellectual property rights in the Platform, including but not limited to the software, user interface design, logos, graphics, learning content, videos, quizzes, and documentation, are owned by us or our licensors.
User content. Any progress data, feedback, or suggestions you submit to the Platform remains your ownership, but you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such data to provide and improve our services (in alignment with our Privacy Policy).
We aim to keep our Platform available 24/7. However, we do not guarantee uninterrupted availability.
Uptime & hosting. Our infrastructure is hosted on Netlify and MongoDB Atlas. We are not liable for any downtime, service interruptions, or data loss arising from issues directly related to these third-party cloud service providers.
Modifications. We reserve the right to modify, update, suspend, or discontinue any feature, course module, or part of the Platform at our sole discretion with or without notice.
Pricing. Access to certain features or learning tracks may require payment of fees. All fees are quoted in Indian Rupees (INR) or other specified currencies, exclusive of applicable taxes (such as GST). See the pricing page for current plans.
Subscriptions. If you sign up for a subscription plan, you agree to recurring billing cycles.
Refund policy. Unless explicitly stated otherwise or required under applicable Indian consumer protection laws, all payments made on the Platform are non-refundable.
As-is basis. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties of any kind, whether express, implied, or statutory, regarding the completeness, accuracy, or suitability of the learning materials.
Limitation of liability. To the maximum extent permitted by applicable Indian law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Platform.
Maximum liability. In no event shall our total liability for all claims relating to the Platform exceed the total amount of fees paid by you to us in the 3 months preceding the event giving rise to the claim.
Termination by you. You may terminate your account at any time by contacting us or using the in-app account deletion feature.
Termination by us. We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you violate any provision of these Terms or engage in conduct that we deem harmful to other users or the Platform.
Effect of termination. Upon termination, your right to use the Platform ceases immediately. Sections covering Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law shall survive termination.
Governing law. These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
Dispute resolution. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved amicably. If an amicable settlement is not reached within 30 days, the dispute shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended).
Jurisdiction. The seat and venue of arbitration shall be Bengaluru, Karnataka, India. Subject to the arbitration clause, the courts in Bengaluru shall have exclusive jurisdiction over any disputes.
